Since they are appointed on the basis of public procurement procedures, they are obliged to adhere to the provisions of the public procurement legislation.  They also have contractual obligations and rights under domestic law.

Nonetheless, the special nature of the project, in other words the fact that financing comes from both Community and national funds, charges contractors with certain additional procedural obligations. 

Contracting authorities in turn are obliged to inform contractors about their obligations assumed as final recipients (such as the obligation to accept on-the-spot inspections by the competent 3rd CSF inspection teams). 

These obligations are enshrined in the decision including an operation for financing under the InfoSoc Operational Programme. Nonetheless, the contracting authorities have the discretion during tendering and upon contract signing to exercise all due diligence and include special terms in tender notices or clauses in contracts.
